Terms of Service

These terms govern your use of the Franscale platform and this website. By using either, you agree to these terms. If you don't agree, please don't use the service.
1. The service
Franscale provides a software-as-a-service customer relationship management platform purpose-built for franchise recruitment. The service is provided by Franscale Ltd, a company registered in England and Wales.
2. Your account
To use Franscale, you need to create an account. You must provide accurate information and keep it up to date. You're responsible for maintaining the confidentiality of your login credentials and for all activity that happens under your account.
3. Acceptable use
You agree not to:
- Use the service for anything illegal, harmful, or fraudulent.
- Attempt to access another customer's data, or interfere with the service's operation.
- Reverse-engineer, decompile, or attempt to extract the source code of the platform.
- Use the service to send unsolicited bulk email or spam.
- Upload data that you don't have the right to process, or that infringes anyone else's rights.
4. Subscription & payment
Subscriptions are billed monthly or annually in advance, in pounds sterling, plus VAT where applicable. Payment is due on the invoice date. Late payment may result in suspension of service after notice. Prices may change with at least 30 days' notice; existing subscriptions are honoured at the agreed price for the remainder of the billing period.
5. Cancellation
You can cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access until that date. We don't charge cancellation fees and we don't lock you in.
6. Data ownership & export
You own all the data you upload to Franscale. We don't use your data for anything other than providing the service to you. On request — at any time, including after cancellation for up to 90 days — we will export your data in a structured, machine-readable format at no cost.
7. Service availability
We aim for 99.9% monthly uptime. We carry out planned maintenance outside UK business hours where possible and notify you in advance. We can't guarantee uninterrupted access, but we work hard to keep the service running.
8. Intellectual property
The Franscale platform, software, branding, and documentation are the intellectual property of Franscale Ltd. You receive a non-exclusive, non-transferable licence to use the service during your subscription. Your data remains yours.
9. Confidentiality
We treat your data and the contents of your account as confidential. We don't share, sell, or disclose your data except where required by law or where you instruct us to.
10. Limitation of liability
To the extent permitted by law, our total liability to you for any claim arising from the service is limited to the fees paid by you in the 12 months preceding the claim. Neither party is liable for indirect, consequential, or special damages. Nothing in these terms limits liability for fraud, gross negligence, or anything else that can't be limited under English law.
11. Termination
We may suspend or terminate your account if you materially breach these terms, fail to pay fees, or use the service in a way that risks harm to us or other customers. We will give you reasonable notice and an opportunity to cure where possible.
12. Changes to these terms
We may update these terms from time to time. Material changes will be notified by email at least 30 days before they take effect. If you don't agree to the changes, you can cancel before they apply.
13. Governing law
These terms are governed by the laws of England and Wales. Any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.
